RebateGain - Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “your”, the “User”, or the “Trader”) and RebateGain (“RebateGain”, “we”, “us”, or “our”), the operator of the website located at rebategain.com and any related dashboards, tools, and services (together, the “Service”). By accessing or using the Service, creating an account, or receiving a rebate through us, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

Please read these Terms together with our Privacy Policy and our Risk Disclaimer, which are incorporated into these Terms by reference. If there is any conflict between these documents on a specific point, the document most directly addressing that point governs.

1. What RebateGain Is – and Is Not

RebateGain is a forex rebate (cashback) provider. We have referral and partnership arrangements with third-party brokers. When you register a trading account with one of our partner brokers through RebateGain, the broker shares a portion of the spread or commission it earns from your trading activity with us. We then pass an agreed share of that amount back to you as a “rebate”, paid on eligible trades whether those trades close in profit or in loss.

RebateGain is an independent service. We are not a broker, a dealer, an investment firm, a financial adviser, a portfolio manager, or a money services business. We do not:

  • execute, route, fill, or hold any trades or positions on your behalf;
  • hold your trading capital, margin, or deposits;
  • set, control, or influence spreads, commissions, swap rates, slippage, execution quality, or any other trading condition offered by a broker;
  • provide trading signals, investment advice, tax advice, or legal advice;
  • guarantee the performance, solvency, conduct, or continued operation of any broker.

Your trading relationship – including the opening, funding, operation, and closing of your trading account – is strictly between you and your chosen broker, and is governed by that broker’s own terms, policies, and regulatory framework. RebateGain is not a party to that relationship.

2. Eligibility

To use the Service you must:

  • be at least 18 years old, or the age of majority in your jurisdiction if higher;
  • have the legal capacity to enter into a binding contract;
  • not be a resident of, or accessing the Service from, any jurisdiction where forex trading, rebate/cashback arrangements, or the use of the Service would be unlawful;
  • not be a person subject to sanctions, or located in a sanctioned territory, under applicable United Arab Emirates, United Nations, or other relevant sanctions regimes;
  • provide accurate, current, and complete information when registering and keep it up to date.

It is your responsibility to ensure that using RebateGain, trading forex, and receiving rebates are legal where you live. We may refuse, suspend, or terminate access where we reasonably believe an eligibility requirement is not met.

3. Accounts and Registration

Some features require you to create a RebateGain account and to link one or more trading accounts held with our partner brokers. To track rebates correctly, you must register your broker account through our referral link or provide your broker account/trading identifiers exactly as instructed in the dashboard.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@rebategain.com if you suspect any unauthorised access or use. We are not liable for any loss arising from your failure to safeguard your credentials.

Each User may hold one RebateGain account unless we expressly agree otherwise in writing. Creating multiple accounts to obtain rebates you would not otherwise be entitled to is prohibited and may result in forfeiture of rebates and termination.

4. How Rebates Are Calculated and Paid

Rebate rates depend on the broker, the account type, the instrument traded, and the volume generated. The applicable rate for each broker is shown on the relevant broker page or in your dashboard. Rates are quoted per lot, as a portion of spread or commission, or on another basis specified for that broker.

Rebates accrue only on eligible, fully executed and closed trades that the broker reports to us and pays us for. The following general conditions apply:

  • Your broker account must be correctly linked to RebateGain before a trade is placed; trades on accounts that were not linked at the time of execution generally do not qualify.
  • Rebates depend on RebateGain actually receiving the corresponding payment from the broker. If a broker does not report, delays, reduces, reverses, or fails to pay us for your activity, the related rebate may be delayed, adjusted, or withheld accordingly.
  • Trades that the broker classifies as abusive, non-genuine, arbitrage, latency/feed exploitation, or that are reversed, voided, or charged back may be excluded.
  • Rebate amounts are estimated until confirmed and settled. Confirmed figures shown in your dashboard reflect amounts we have reconciled with the broker.

Rebates are not credited to your account automatically. To receive your rebate, you must submit a withdrawal request through your dashboard. Our support or operations team then reviews the request and, once it is verified and approved, the corresponding amount is added to your dashboard balance and shown there. We aim to review valid requests within five (5) business days; this is a target, not a guarantee, and delays caused by broker reconciliation cycles, payment networks, additional verification, or other factors outside our reasonable control may extend this timeframe. Supported payout methods (such as e-wallets or crypto wallets) and any minimum request threshold are shown in your dashboard and may change. You are responsible for providing accurate payout details, including the correct wallet address. We are not responsible for funds lost due to incorrect, outdated, or fraudulent payout information you provide.

You acknowledge and agree that any transaction, network, or processing fees associated with your chosen payout method (for example, crypto network or gas fees, such as those on the Tether TRC-20 network) will be deducted directly from your approved payout balance. As a result, the amount you actually receive may be lower than the balance shown in your dashboard.

Rebate rates and terms are not fixed and may be changed, increased, reduced, or discontinued at any time, including where a broker changes the terms on which it pays us. Where reasonably practicable we will reflect current rates in the dashboard. Continued use after a change constitutes acceptance of the updated rates, which will apply only to trades executed after the effective date of the change. Any such change does not affect rebates already accrued, confirmed, or approved on trades executed before the effective date.

5. Taxes

You are solely responsible for determining, reporting, and paying any taxes, levies, or duties that apply to rebates you receive under the laws of your country of residence or citizenship. RebateGain does not withhold taxes on your behalf and does not provide tax advice. If in doubt, consult a qualified tax professional.

6. The Broker Relationship and Third Parties

The Service relies on third-party brokers and, in some cases, on third-party payment, analytics, and infrastructure providers. While we work only with brokers we choose to partner with, we do not endorse, guarantee, or accept responsibility for any broker’s regulatory status, financial condition, execution, fees, withdrawal handling, or treatment of your funds.

Any dispute concerning your trading account, deposits, withdrawals, or execution must be resolved directly with the broker. We may, at our discretion and where able, try to assist by relaying information, but we have no obligation or power to compel a broker to act.

7. Acceptable Use

You agree not to, and not to attempt to:

  • use the Service for any unlawful, fraudulent, or deceptive purpose, including money laundering or terrorist financing;
  • manipulate, game, or exploit the rebate system, including through wash trading, self-trading between accounts, collusive trading, or generating artificial volume solely to harvest rebates;
  • create accounts using false, stolen, or another person’s identity or payout details;
  • interfere with, disrupt, probe, or attempt to gain unauthorised access to the Service, its servers, or related systems;
  • scrape, copy, republish, or commercially exploit any part of the Service or its content without our written permission;
  • use bots, scripts, or automated means to access the Service in a manner that burdens our infrastructure or circumvents controls.

We may investigate suspected breaches and may withhold or reverse rebates, suspend or close accounts, and report unlawful activity to brokers or authorities where appropriate.

8. Intellectual Property

The Service, including its design, dashboard, text, graphics, logos, the “RebateGain” name and brand, software, and the selection and arrangement of content, is owned by RebateGain or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial purpose of obtaining rebates. No other rights are granted.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, that rebate estimates will match final settled amounts, or that any broker will continue to participate. Forex trading carries a high level of risk; rebates reduce trading costs but do not eliminate risk or guarantee profitability. Please read our Risk Disclaimer.

10. Limitation of Liability

To the maximum extent permitted by applicable law, RebateGain and its owners, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, trading losses, loss of data, loss of goodwill, or business interruption, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Service is limited to the total amount of confirmed rebates actually paid by us to you in the three (3) months immediately preceding the event giving rise to the claim, or USD 100, whichever is greater. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold harmless RebateGain and its owners, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Service, your trading activity, or your violation of any law or third-party right.

12. Suspension and Termination

You may stop using the Service and request closure of your RebateGain account at any time by contacting support@rebategain.com. We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive activity, or created legal or reputational risk for us, or if required by a broker, law, or regulator.

On termination, your right to use the Service ends. We will endeavour to pay out any confirmed, eligible rebate balance that has been approved (or that you have requested and we approve following our standard review), that meets the applicable minimum request threshold, and that is not subject to investigation, reversal, or clawback, using the payout details on file. Rebates linked to activity later reversed by a broker may be recovered or offset.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when the latest version took effect. Material changes will be reflected on this page and, where appropriate, communicated through the dashboard or by email. Your continued use of the Service after changes take effect means you accept the revised Terms.

14. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or formation (including non-contractual disputes) are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws principles.

The parties will first try in good faith to resolve any dispute amicably by contacting support@rebategain.com. If a dispute cannot be resolved within thirty (30) days, it will be subject to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates, except where mandatory local consumer-protection law gives you the right to bring proceedings in your country of residence.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition, or transfer of assets. These Terms, together with the Privacy Policy and Risk Disclaimer, are the entire agreement between you and RebateGain regarding the Service.
