This Risk Disclaimer applies to your use of RebateGain and the website at https://rebategain.com (the “Service”). Please read it carefully. By using the Service you confirm that you understand and accept the risks described below. This Disclaimer forms part of, and should be read together with, our Terms of Service and Privacy Policy.
1. RebateGain Is a Rebate Provider, Not a Broker or Adviser
RebateGain pays you back a portion of the spread or commission you generate when you trade with our partner brokers. We are not a broker, financial institution, investment firm, or financial adviser. We do not execute trades, hold your funds, manage accounts, or provide personalized investment, legal, or tax advice. Nothing on the Service is a recommendation to trade, to use any particular broker, or to buy or sell any instrument.
2. Forex and Leveraged Trading Carry a High Risk of Loss
Trading foreign exchange (forex) and other leveraged products is speculative, complex, and carries a high level of risk. It is not suitable for everyone. You can lose some or all of your invested capital, and in some account types you may lose more than your initial deposit. Key risks include:
- Leverage: leverage magnifies both gains and losses, and small market movements can have a large effect on your account.
- Market volatility: prices can move sharply and unpredictably, including gaps, spikes, and slippage.
- Liquidity risk: in fast or thin markets, orders may not fill at expected prices.
- Counterparty and broker risk: the financial condition, conduct, and regulatory status of your broker are outside our control.
- Technology risk: connectivity, platform, or execution failures can affect your trades.
Past performance is not a reliable indicator of future results. Only trade with money you can afford to lose, and seek independent advice from a licensed professional if you are unsure.
3. Rebates Reduce Costs – They Do Not Remove Risk or Guarantee Profit
Rebates lower your effective trading costs by returning part of the spread or commission you already pay. They are paid on eligible trades whether those trades win or lose. However:
- rebates do not eliminate trading risk and do not guarantee that you will be profitable;
- receiving rebates should never be a reason to trade more frequently or in larger size than your strategy and risk tolerance justify;
- trading purely to generate rebate volume (overtrading) is likely to increase your losses, not reduce them.
A rebate is a cost reduction, not a source of income independent of your trading decisions.
If a partner broker flags your trading activity as “churning” (rapidly opening and closing positions mainly to generate commission or rebate volume), market abuse, or artificial volume generation, the broker may reduce or withhold the commission it pays us. In that case, RebateGain reserves the right to void, cancel, or reverse your corresponding rebates entirely. You may also have your broker account restricted or closed by the broker under its own rules.
4. Rebate Amounts Are Variable and Not Guaranteed
Rebate rates depend on the broker, account type, instrument, and volume, and are subject to change. Figures shown before settlement are estimates. Actual rebates depend on the broker correctly reporting and paying us for your activity. If a broker delays, reduces, reverses, or fails to make payment, your rebate may be delayed, adjusted, or withheld. Rebates are paid only after you submit a withdrawal request and it is reviewed and approved, and the amount you finally receive may be reduced by transaction, network, or processing fees charged by your chosen payout method (for example, crypto network or gas fees). RebateGain does not guarantee any specific rebate amount, rate, or payout timing.
5. No Guarantees About Brokers
We partner with brokers we choose to work with, but we do not endorse or guarantee any broker’s regulatory standing, financial stability, execution quality, fees, or handling of your deposits and withdrawals. Your trading account relationship is governed by the broker’s own terms. You are responsible for assessing whether a broker is appropriate and properly regulated for you, and any dispute about your trading account must be resolved directly with the broker.
To the maximum extent permitted by law, RebateGain is not liable for any broker insolvency, bankruptcy, liquidation, exit scam, fraud, regulatory action, loss of license, or freezing, withholding, or loss of client funds. You acknowledge that you deposit and hold funds with third-party brokers entirely at your own risk, and that the fact a broker appears on the Service is not a recommendation, guarantee, or assurance of that broker’s safety or solvency.
6. Your Responsibility
You are solely responsible for your trading decisions and their outcomes, for choosing your broker, for confirming that forex trading and rebate arrangements are legal in your jurisdiction, and for meeting any tax obligations on rebates you receive. RebateGain accepts no liability for trading losses or for decisions you make based on information available on the Service.
7. No Warranty on Information
Information on the Service – including educational content, examples, and rebate calculations -is provided for general information only and may contain errors or become out of date. It does not constitute financial, legal, or tax advice. Information on the Service may also be subject to delays, data lags, or human error, and broker conditions can change before our website or dashboard is updated. RebateGain does not warrant that rebate rates, percentages, prices, or broker conditions displayed on the Service are real-time, current, or completely error-free; the binding figure is the rate confirmed and reconciled at the time of settlement. To the maximum extent permitted by law, RebateGain disclaims all warranties regarding the accuracy or completeness of such information.
8. Limitation of Liability
To the maximum extent permitted by applicable law, RebateGain and its owners, officers, employees, and partners will not be liable for any trading losses or for any indirect, incidental, special, or consequential damages arising from your trading activity, your choice of broker, or your use of the Service. This Disclaimer is subject to the limitations and governing-law provisions set out in our Terms of Service, which are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.
